Over the years, immigration laws have become increasingly stricter. Individuals requesting admission into our country are forced to battle with frustrating legal antics and never-ending piles of paperwork implemented by an overprotective need to limit foreign access. The United States keeps a very tight reign over the amount of people that flow in and out of this country. If you are an immigrant, you are forced to consider hiring professional help in order to get through the process.

Some people are tempted to try and wrestle the vigorous application process on their own. This can be a bit of a gamble.  There are many types of visas and applications, how do you know for sure which is the best one for your situation? How do you know if you will qualify? How do you know the correct way to fill out the forms? What information should be included?  What information should not be included? What is the best timing to submit the applications? Where are they submitted? How do you prepare for the interviews? Who will go with you to the interviews? Hiring an immigration lawyer can be the answer to all your question as well as a clever way to optimize the chances of approval on an immigration application. There are pros and cons to every decision, however. Here are some of the pros and cons of hiring an immigration attorney.

Pro: Certified to Handle Legal Issues

If you are in the process of filling out the required immigration forms, then it is possible that all the legal jargon has already started to make your head swim. While some people think that the self-filing process is straightforward and to the point, applications are immensely hard to navigate.  Ultimately, you may end up making a mistake that delays your application or worse. Hiring an attorney lowers the chance of making a case-crippling mistake and ensures that your case is in the hands of an individual who is bar certified and capable. In addition, an immigration lawyer specializes in getting applications approved, and likely has had experience with dozens if not hundreds of cases similar to your own.

Con: Costly

You may be saying to yourself at this very moment “Why spend the money? Paperwork is simple.” Some people are under the impression that the immigration process is something that can easily be done with no professional help.  Having a do-it-yourself attitude is sometimes a great way to save money.  For example, washing your own car, or mowing your own lawn… these are simple tasks which can be done inexpensively and on your own with results just as good as hiring a professional.  When considering your immigration status, on the other hand, it is is not such an everyday task.  It is a much more important job with much more serious repercussions.  The immigration application decisions are also made by real people, not computers.  It can be to your advantage to have a real person on your side. One small mistake in the process could set you back years. You get what you pay for with immigration services; if your status in the United States is important, then why risk it? Hiring a licensed attorney, while expensive, is the best way to ensure success.

Pro: Avoid Delays and Resolve Legal Complications

Filling out paperwork is not as easy as it sounds, especially when it involves immigration. There may be times where you’ve filled out the absolute wrong form and are forced to start back from square one. There may be moments when an official tells you to fill out one form, when you really needed to complete another form. Because immigration attorneys are familiar with the necessary requirements, they are able to expedite the amount of time it takes to complete the process. They also have the much needed knowledge to correct, petition, or appeal any legal complications that may arise once the application is in progress.

Con: Disreputable Services Exist

Most people can spot a fake when they see one.  There are, however, some dishonest individuals who profit off of the people struggling with the immigration process. Hiring a phony lawyer or an unqualified person can potentially have a crippling effect on your case and leave you in a precarious situation. A illegitimate attorney will not be able to provide you with a valid bar number. A notary or other type of service simply is not qualified to represent you in front of immigration officials or a judge. Look for the signs, and avoid any services that are not properly licensed to represent you.

If you are torn between getting an immigration attorney and doing it yourself, just remember that you get what you pay for. Millions of immigration applications are denied each year.
