Migrant Children Need Legal Representation

A migrant child should never have to go before a judge alone and advocate why they deserve asylum. However in the United States, where migration is still a civil offense, it occurs everyday. A child who flees violence in Central America may be sent back simply because he or she lacks legal representation. Entering the United States illegally is a civil offense which means those brought before a court on such a charge are not guaranteed a lawyer. Although it is a civil offense, the ramifications of deportation may be great. For a child immigrant to be sent back to a country after fleeing violence, simply because he or she lacks an advocate is a scary experience to say the least. However, that may be changing in California for children and those with disabilities who immigrated illegally.  San Jose’s Rep. Zoe Lofgren’s has proposed a bill to change this.

The bill proposed provides government appointed attorneys for children and those with disabilitiesseeking asylum in the United States. This bill could mark an incredible shift for the thousands of migrant children currently facing deportation. Considering that 7,706 migrant children were recentlyordered for deportation after missing their day in court, obtaining legal advocacy is paramount to remaining in the United States.

Over 90% of Migrant Children Appear In Court When Given Legal Representation

A recent government study bySyracuse University’s Transactional RecordsAccess Clearinghouse (TRAC), shows unequivocally that migrant children with legal representation are far more likely to show up for their day in court. TRAC’s data tabulated that an astonishing 92.5 % of children appear for their court date when represented, versus a dismal 27.5% who show up unrepresented. It is also uncontested that a migrant child that appears with legal representation has a far better chance of not being deported versus a child without legal representation.  Thus having an attorney for a migrant child not only increases their chances of remaining in the US but also helps due process to run smoothly.

Policy Opposing Legal Representation for Children Seeking Asylum

Many migrant children have a valid claim for asylum.  As the rampant violence and drug war continues to tear Central America apart, many victims find themselves at the doorsteps of the United States. Despite a valid claim for asylum and the TRAC study,  there are still opponents that believe migrant children do not require court appointed representation. Recently, immigration Judge Jack H. Weil asserted that a 3 year old migrant child can represent herself in her deportation case.  Although this assertion is contrary to countless studies, many adopt this line of thinking. Rep. Lofgren’s bill may never come to fruition.
