Everything You Need to Know About the Recent Supreme Court Decision

The Supreme Court split (4-4) over whether Obama’s administration could implement sweeping immigration reforms, known as DAPA and DACA, was seen as a setback for many migrants desperately waiting for a favorable decision.  Now that this decision has been made, here is some important information moving forward about immigration law:

What does the 4-4 split mean?

This means Obama’s DACA eligibility programs (estimated to benefit over 5 million people) will not go forward, and the case will go back to the lower courts for further decision making.

What happens to DACA?

The program Obama introduced in 2012, known as Deferred Action for Childhood Arrivals (DACA), will remain in place unchanged. The recent Supreme Court decision did not include the original 2012 DACA program, only the expansion Obama passed in 2014.

Can Obama’s Administration ask for a Rehearing?

Yes. The Obama Administration can ask for a redo by the Supreme Court once a ninth judge is appointed to fill the vacant seat the late Justice Antonin Scalia held before he passed away. U.S. Attorney General Loretta Lynch said Tuesday that the administration will be reviewing the case and seeing what, if anything else, they can do in court.

What is next?

Obama said that his administration will continue its long established policy of moving slowly on deporting parents of children who are in the United States legally. Those adults, however, will not be given work permits, making it more difficult to find employment. The Supreme Court decision does not require the administration to begin deportations of the affected immigrants.

The Supreme Court decision will also affect whomever becomes the next President. In other words, had the Supreme Court sided with Obama, then the next President would essentially be handed an approval from the Supreme Court to pass whatever sweeping immigration reform they desire, including the immigration reform argued by Presidential candidate Donald Trump. Accordingly, some immigration proponents see this decision as a safe outcome in light of the upcoming presidential elections, should Trump prevail.

There are other avenues of legal immigration

This decision does not affect alternative avenues for legal immigration such as asylum, u-visa (for victims of crimes), investor visas, family based petitions, and more.
