7 Facts about Deportation

No matter the reason, deportation can be a scary experience.  If you are caught as an illegal immigrant in the U.S. you aren’t left with many options – the most likely outcome will be deportation.  You do have some options.  It is important to consult an immigration lawyer to find out exactly what they are. There are many things about deportation that most people do not know.  Below are seven essential facts about deportation.  

 

1. It is not always about being undocumented.

Undocumented or illegal immigrants are not the only people being deported. Many people are deported due to expired visas or passports; sometimes even violating the terms of a valid visa (see #6 below).

 

2. The majority of people want to stay and contribute. 

No one asks to be deported.  Most people enter this country (legally or illegally) to seek a better life or to be with their family.  Almost all immigrants are seeking work in this country; and many find it – almost 5% of the entire U.S. workforce is made up of undocumented immigrants.

 

3. Deportation is expensive to the government.  

The U.S. could find and deport a lot more illegal immigrants if they wanted to spend the money.  The resources of the INS, Border Patrol and Customs actually are only part of the cost. The most costly parts of deportation for the U.S. government are legal costs and transportation.  It costs $13,000 to deport one person.  If they were to deport all of the estimated 11 million illegal immigrants, it would cost around 143 billion dollars!

 

4. Detaining immigrants is even more expensive.

Some captured illegal immigrants either can’t afford a bond or are determined to be a risk to the public. These people are jailed until their immigration proceedings are complete.  Department of Homeland Services spends more than 5 million dollars a day detaining people awaiting immigration trials.

 

5. Illegal immigrants can appeal to the court.

While illegal immigrants aren’t afforded all the constitutional rights that a U.S. citizen receives, they do get some.  Even an illegal alien has rights that are inalienable.  In fact, Illegal immigrants are allowed due process and are able to appeal their deportation cases – sometimes all the way to the Supreme Court.

 

6. Documented immigrants can face deportation.

Even a documented and legal immigrant can face deportation.  Criminal convictions, falsified documents, or violating the terms of an existing and valid visa can put a legal immigrant in danger of deportation.   

 

7. Deportation rates have increased dramatically.

America is deporting immigrants at nine times the rate of 20 years ago.  You no longer have to go to the border in order to see a border patrol agent; they are actively patrolling your town.  When Barack Obama took office in 2008, deportations continued to rise.  Nearly 2 million people have been deported under his presidency.  Some groups have even nicknamed him the deporter in chief.

 

Deportation, as it stands, is an expensive process for the government.  For the person being deported, it can mean being ripped away from your family or losing the job that puts food on the table.
