What Happens in Deportation Cases?

Remember:

  • You have the right to a court interpreter at all hearings in your native language;
  • You have the right to an immigration attorney, but not at the government’s expense;
  • You may have the right to see an immigration judge to fight your case; and
  • You have the right to contact your consulate.

What if I take “voluntary return” or agree to my deportation?

  • Sometimes Immigration Customs and Enforcement (“ICE”) will ask if you want to sign a voluntary return or a voluntary departure. You may be told that you can fight your case from your home country, that you will not lose your green card, or that you will be able to return after three or ten years. You cannot fight your immigration case from your home country. Some people may never be able to legally return to the U.S., especially if they have a criminal conviction. Green card holders will lose it.

What Happens in Immigration Court?

Remember, immigration cases can last months or sometimes years.

  • Master Hearing: This is a short first hearing. The judge will inquire into your case and schedule upcoming hearing dates (if any). At this hearing, you can request more time to find an immigration attorney or to prepare your case.
  • Bond Hearing: If you are detained by immigration enforcement, you may be released if you are eligible and pay a bond. If ICE does not give you a bond, then you can request a bond from an immigration judge. Not everyone is eligible for a bond, but if ICE says you’re not, then it is a good idea to check with the judge to make sure. At the bond hearing, the judge will want to see that you’re not (1) a flight risk, and (2) not a danger to the community.
  • Merits/Individual Hearing: This is the hearing where you present all of your evidence and argue your case.
